1 - Purpose
The general terms and conditions of sale described below detail the rights and obligations of Gabriel Armoury (a sole proprietorship under the name of Gabriel Vimar, SIRET No.: 51453015300014) and its customers in the context of the sale of the following goods: harnesses, armor parts, and historical reenactment accessories. Any service provided by Gabriel Armoury implies the buyer's unconditional acceptance of these general terms and conditions of sale.
2 – Prices & Validity of Sales Offers
Goods are invoiced at the rate in effect on the day the order is placed. Gabriel Armoury reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in effect at the time the order is registered. Prices on our website are indicated in euros and do not include shipping costs. Note: VAT not applicable, article 293B of the French General Tax Code. Shipping costs appear on the screen at the end of the client’s product selection. Products are offered for sale while stocks last. If a product becomes unavailable after ordering, the customer will be informed as soon as possible by email or postal mail.
3 - Delivery
Delivery is made either by direct handover of the product to the buyer, by notice of availability, or by delivery to a shipper or carrier at the seller’s premises or any other designated location. The buyer must check the goods upon receipt. In the case of damage or missing items, or complaints about visible defects or non-compliance of the delivered product, the buyer must make clear and precise reservations within three days from the delivery date, in writing to the carrier. The buyer must provide any proof necessary regarding the existence of the noted anomalies.
4 - Delivery Times
All production times are provided strictly as estimates. The current average waiting time is between 9 and 12 months. However, in case of urgency, do not hesitate to contact us: our urgent rush orders may allow us to complete pieces within a very short timeframe for a 30% surcharge. If Gabriel Armoury is unable to meet the mutually agreed date specified in the signed quote (and both the deposit and the 30% surcharge have been paid upon signing), then Gabriel Armoury will fully refund the 30% surcharge to the client.
5 - Returns
Any product return must be formally agreed upon between the seller and the buyer.
6 - Warranty
The seller will take the utmost care in fulfilling the order and ensuring the quality of the products. In case of a defect acknowledged by the seller, the obligation will be limited to the replacement or reimbursement of the defective quantities, without further compensation. Excluded from the warranty are defects and damage resulting from abnormal or non-compliant storage, handling, transport, or use inconsistent with the nature or intended use of the product.
7 – Payment
For in-stock items: Payment is required when the order is placed. Payments may be made by check, PayPal, or bank transfer. Goods will be shipped after payment is received. For custom harnesses and personalized items: A deposit of 50% of the total order amount is required. The deposit is payable by check, PayPal, or bank transfer. The balance is due before the goods are shipped or upon hand delivery. In case of late payment, the seller may suspend all current orders. Any amount unpaid by the due date indicated on the invoice will automatically result in late payment penalties equal to one and a half times the legal interest rate. These penalties are payable upon simple request by the seller. No discount is offered for early payment.
8 - Termination Clause
In the event of non-payment, forty-eight hours after an unsuccessful formal notice, the sale will be automatically terminated by the seller, who may seek the return of the goods through expedited proceedings, without prejudice to any other claims for damages. Any outstanding amounts for other deliveries will become immediately due unless the seller chooses to terminate the corresponding orders.
9 - Retention of Ownership
Goods sold remain the property of the seller until full payment is received. However, the risks associated with the goods are transferred to the buyer or carrier upon physical delivery.
10 - Jurisdiction
These online sales terms are subject to French law. Any dispute related to them will fall under the jurisdiction of the courts of Paris.
11 - Product Presentation
As most of these products are handcrafted, slight variations may exist compared to the photos shown. These differences shall not be considered contractual. All advice and information provided by Gabriel Armoury are for reference only, and Gabriel Armoury cannot be held responsible for misuse by the user.
12 – Copyright
All texts and images on the Gabriel Armoury website are protected worldwide under copyright and intellectual property laws. Reproduction, even partial, is strictly prohibited.
13 - Right of Withdrawal
In accordance with Article 121-18 of the French Consumer Code, private customers have a right of withdrawal. If for any reason the products are not suitable, they may be returned. Returns must be made via registered mail within 7 days of delivery, with a letter including the address, invoice number, and a request for a refund. Items must be returned in their original packaging and must not have been used. The full order amount will be refunded within thirty days of receipt of the returned goods. Return shipping costs are the responsibility of the customer.
